These Terms of Service ("Terms") govern your access to and use of aimarketfrog.com and the AiMarketFrog services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of terms

By accessing or using the Service, you confirm that you can form a binding contract and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

AiMarketFrog is a social media workspace that lets you generate images and content with AI, and publish or schedule posts to connected social media accounts such as Instagram and Facebook. We may update, change, or discontinue features at any time.

3. Accounts

  • You must provide accurate information and keep your account details up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must notify us promptly of any unauthorised use of your account.

4. Free trial and subscriptions

  • The Free plan provides access for 14 days. After the trial, continued use of paid features requires a subscription.
  • The Starter plan is billed at ₹2000 per month and includes AI image generation, auto-posting, and scheduling.
  • Fees are charged in advance and are non-refundable except where required by law.
  • You may cancel at any time; access continues until the end of the current billing period.

5. Your content

You retain ownership of the content you upload or create ("Your Content"). By using the Service, you grant AiMarketFrog a limited licence to store, process, and transmit Your Content solely to operate the Service and publish posts at your direction.

6. AI-generated content

The Service uses AI to help generate images, captions, and other content. AI output may be inaccurate or resemble other content. You are responsible for reviewing generated content before publishing and for ensuring it complies with applicable laws and the rules of any platform you post to.

7. Connected social accounts

When you connect third-party social media accounts, you authorise AiMarketFrog to publish and schedule posts on your behalf. Your use of those platforms is also subject to their own terms and policies, and we are not responsible for their actions.

8. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, deceptive, or abusive purposes.
  • Post content that is illegal, infringing, hateful, or violates third-party rights.
  • Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
  • Use the Service to send spam or violate any platform's policies.

9. Intellectual property

The Service, including its software, design, and branding, is owned by AiMarketFrog and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, AiMarketFrog will not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill arising from your use of the Service. Our total liability will not exceed the amount you paid us in the 12 months before the claim.

12. Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm. You may stop using the Service and delete your account at any time.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated version and revise the "Last updated" date. Continued use of the Service after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in India.
